"I am not a criminal." This phrase was adamantly professed by Tricky Dick. For those of you not familiar with American Politics Richard Nixon. While I don't have many things in common with Richard Nixon, this will be one of them. I am adamantly professing I AM NOT A CRIMINAL!
I'm sure that a few of you saw my post some time back regarding an issue I had with child support. I am a divorced and remarried father. I have a son from a previous marriage and I have been paying faithfully for 15 1/2 years. He's my kid and I love him dearly. He spends a great deal of time with me, and even though I could have gone back to court to get the payment arrangements changed, I figured if it's not hurting me, maybe it can help him (finacially) so I left it.
I won't go into all the specifics from last time, but the bottom line is I have been paying a double payment because of some dishonesty by the other parent. I was foolish enough to try and help out and got burned, so now I'm basically at the mercy of the California Department of Child Support Services. They are essentially in the same category as Macy's to me... Call em the devil or the anti-christ it's the same thing...
I sent about 5 letters and made so many phone calls it's not even funny. I had my money returned the last time (except for that $100 that BofA keeps for an admin fee). This time they did it again without warning. I'm fed up with their system of doing things. There is no way short of spending all the time and MONEY you need for court to get this resolved. The child support system is purely a collection agency. They don't care or want to know what the situation is. They don't want to be bothered with the specifics of anything. Just pay on time and they will leave you alone. Don't pay on time, or have an issue and you are gonna have problems. A levy on your bank account, a lien on your home, your drivers license could get suspended. There are a number of things they could do, and more things that they threaten to do.
I sent one more letter in an attempt to get some reaction from these less than cooperative people. I'm gonna share that with you. Maybe it was a bit over the top but I don't think so.
To Whom it May Concern,
On Friday March 12, 2010 my bank account had $100.00 removed from it. That left my account with approximately ____ in it. I was informed by the bank that the charge was a non-refundable fee for a levy that is placed on our checking account. This is the second time this has occurred. The last time the account had the money returned to it with no explanations to how or when it happened. I have sent numerous emails without a single response. I would like to know what purpose it serves to apply this levy to an account that doesn't even have the money to cover the cost of the levy? All this has done is cause another hardship upon the remainder of my family.
I would like this matter resolved, and I'm concerned that nobody seems to have the time to respond to a simple email regarding the matter. I have tried phone calls to the local office and have been sent repeatedly to this email. I tried phone calls to the 800 number and they went unanswered. Is the fact that I'm not the custodial parent or the fact that Mrs. _____ is an employee of the state a reason for this office to completely ignore me since November?
All I'm asking for is some due diligence in this matter. My livelihood is threatened as each time this happens I lose yet another $100.00 from my account that won't be returned.

Looking at it again, I realize that it wasn't that staunch at all. I think it brought up the point, but I have yet to receive a response. The State of California is a joke when it comes to Government. They have neither the means nor the will to correct mistakes they make. They lack the leadership, and moral compass required to lead a state of this magnitude. It's no wonder that we are submerged in debt and there are exactly zero long term plans to alleviate the shortcomings. I'm fed up with all the BS that comes with the state.
Wake up State agencies and do the damn job you are paid to do.... Sooner or later somebody with a set of juevos is gonna come along and FIRE YOUR ASS!!!! I just wish it was me or at the very least I could be present when it happens. Until then I will have to decide if I want to spend my money paying support that I don't owe or paying for a lawyer I shouldn't need.

Wow that sucks I would say get a lawyer and go after the state for the $100 just for the principle of it. But I am sure that is not possible as it's more expensive for that then to just deal with it. Which in the end sucks as well. I hope things change.

Can you take the state to small claims court? You can represent yourself.... They'll probably send a lawyer to represent them, and that will cost them more than $100.... So you'd win in that respect. But the lawyer will be paid with taxpayer dollars.... So you're going to get screwed again....
It's ridiculous to see the game our government is playing with the state of California. Nobody cares about their constituents. It's all red and blue. Black and white. Nobody sees across the aisle, they only vote along with their party's designations.... But on the other hand, nobody cares enough to research who they're going to vote for in the election.... If you ask ten random people walking down the street in California, when the next election for the position of Governor of California is going to be held, how many of them do you think will get the answer right? Try asking them to name one person with their name in the running for the open Governor’s seat. Or give them a trick question and ask them if they think Schwarzenegger is going to be able to save the state government next year…..
The state is spending ridiculous amounts of money on ridiculous things…. I bet you that if there was an audit of the funds that our state is spending, we’d find hundreds of millions of dollars just being spend on nothing. Millions spent on programs that have been closed for years, paying people to sit in front of a computer pushing a button every 108 minutes for absolutely no reason whatsoever....
Do you remember the break out story about the State of California not canceling phone lines when they closed down offices and buildings….. So they spent millions of dollars on vacant phone lines, and nobody knew about it…. Then the spent more money hiring people to try and find out what lines worked and what lines just rang and rang and rang….
I’m not going to begin to try to imagine how many people have been fired from their government position, but still have their cell phone paid for by our government. Or how many active government issue cell phones are sitting in a box unused….
Do you remember the whole issue with the LADWP? They spent millions of dollars on an ad campaign, begging people to drink the tap water and to ditch the bottled water. Then we find out that during the same year they put out the commercial, the LADWP spends tens of thousands of dollars on bottled water for their offices…. I guess the sink water isn’t good enough for them….
I wrote something a while back about how the government is now threatening the closure and sale of some of our state landmarks and most famous venues and the land they occupy. http://asblackasobama.blogspot.com/2009/05/orange-county.html . They’re pulling the old bait and switch and instead of looking internally, we’re all going to get screwed in the end. What’s going to happen when we don’t have anything else to sell? The City of Los Angeles alone will have to figure out how to eliminate a $200,000,000+ budget deficit at the end of this year…. How are they going to fix that?
I’m not saying that I have all, or any, or the answers to the problems…. I’m just saying that it’s disappointing.

Pretty much all of the fathers I know who pay child support are fed up, so it sounds like you're not alone. When I hear what some of you pay each month I don't even know how you live... Don't get me wrong, I'm all for child support, but the system definitely has some flaws.
My granddaughter doesn't even get the small amount she's supposed to get. It was to be taken directly from his paycheck. Seems the only way my daughter can do anything about it, is to take him to court. (at least you pay yours) Good Dad!
Yeah and on top of all that, now we're going to be forced to buy health insurance enforced by the rotten IRS! It will soon be called the USSA the United States of Socialist America.
I don't have any cool advice for you, but I can say that I feel your pain...so sorry, it must really suck in so many different ways.

I've also been on the negative end of both a dishonest ex and a "don't give a shit bank." They both suck!

I hate politics and gov't bs too. I am not familiar with how child support works but it seems like it sucks like everything else.

This post really brings me back to some crappy stuff pulled by my EX, I have no problem paying child support and taking care of my kids but what I always had a problem with was she being allowed to play games by throwing me into court for bogus reasons, I got called in for non payment of child support when it was being taken from my paycheck, this was my idea but me having to get documentation from my employer and the child support division to prove that I was not behind only added to the joy of the ex.
I could go on and on but will sum it up by saying situations like this the only winners are the Lawyers because they are getting paid and the rest of us are getting screwed, the dishonest ex's may be smiling but they are screwing with our kids heads and this sucks!!!
